Terms of Service

1. Definitions

• "Account" means the registered profile you use to access the Service.
• "Content" means all software, models, interfaces, text, graphics, and other materials we provide through the Service.
• "Generated Output" means images, videos, metadata, or other materials produced by the Service in response to your inputs.
• "Inputs" means prompts, settings, reference files, and other data you submit to the Service.
• "Points" means the usage credits displayed in your account and consumed when you run generation tasks.
• "User Content" means Inputs you upload and Generated Output you create or store through the Service, excluding our underlying Content.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

You agree to provide accurate registration information and to keep your credentials secure. You are responsible for all activity under your Account. Notify us promptly at team@oriolefly.com if you suspect unauthorized access.

We may refuse, suspend, or terminate Accounts that violate these Terms or pose risk to the Service or other users.

3. The Service

OrioleFly is an independent online studio for AI-assisted image and video generation. It is a wrapper platform that integrates third-party AI models through hosted inference partners; we are not affiliated with or endorsed by those model providers. Features may include model selection, task queues, asset storage, billing, and account management. We may add, change, or remove features at any time.

The Service depends on third-party AI and infrastructure providers. Generation speed, availability, and model catalogs are not guaranteed and may vary with load, maintenance, or provider limits.

We do not guarantee that Generated Output will meet your expectations, be unique, free of errors, or suitable for any particular purpose. You are responsible for reviewing outputs before use.

4. License to use the Service

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

You may not (and may not permit others to): copy, modify, or create derivative works of the Service except as allowed by law; reverse engineer or attempt to extract source code or models; circumvent usage limits, points, or access controls; resell or sublicense the Service; use automated means to scrape or overload the Service; or use the Service to build a competing product.

6. Points, subscriptions, and payments

Some features require Points or a paid subscription. Prices, included Points, storage limits, and renewal intervals are shown on our pricing page or at checkout and may change with notice where required.

Points have no cash value, are non-transferable between accounts, and (unless stated at purchase) do not expire while your Account remains active. Subscription Points may reset each billing period and do not roll over unless we say otherwise. One-time point purchases are credited to your non-expiring free balance as described in-product.

Payments for subscriptions and point packs are processed by Creem, which acts as merchant of record for those transactions. Creem is the legal seller of record for purchases made through our checkout; OrioleFly provides the Service you access. By purchasing, you authorize charges to your selected payment method. Subscriptions renew automatically until canceled through your account billing tools or Creem's customer portal.

Taxes may apply depending on your location. Failed payments may result in suspension of paid features until resolved. See our Refund Policy for refund eligibility.

7. Acceptable use

You agree not to use the Service to:

• Violate any law or infringe intellectual property, privacy, publicity, or other rights of any person;
• Generate or distribute NSFW, pornographic, explicit, or sexually suggestive images or videos;
• Generate or distribute illegal, exploitative, hateful, harassing, deceptive, or violent content;
• Create non-consensual intimate imagery, deepfakes intended to mislead about real individuals, or content that sexualizes minors;
• Upload malware or attempt to probe, scan, or compromise our or others' systems;
• Misrepresent Generated Output as official statements by OrioleFly or any third party;
• Circumvent rate limits, Points, or technical restrictions;
• Use the Service in a manner that could harm minors or expose us or providers to liability.

We may remove content, suspend Accounts, or report activity to authorities when we believe violations have occurred.

8. Our intellectual property

The Service, including our brand, software, and documentation, is owned by us or our licensors and protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted to you.

Feedback you provide may be used by us without restriction or compensation.

9. Third-party services

The Service integrates third-party AI models, payment processors, storage, and other services. Your use may be subject to additional terms imposed by those providers. We are not responsible for third-party services beyond our reasonable control.

Links to external sites are provided for convenience; we do not endorse and are not responsible for third-party content or practices.

11. Disclaimers

THE SERVICE AND ALL GENERATED OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI systems can produce inaccurate, biased, or offensive material. You are solely responsible for how you use Inputs and Generated Output.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORIOLEFLY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

13. Indemnification

You will defend, indemnify, and hold harmless OrioleFly and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

14. Suspension and termination

You may stop using the Service at any time. You may cancel subscriptions through the billing tools we provide.

We may suspend or terminate access immediately for violations, risk to the Service, non-payment, or legal requirements. Upon termination, your license ends and we may delete Account data subject to our Privacy Policy and legal obligations.

Sections that by nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be notified by email or in-product notice where appropriate.

Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law. If you do not agree, you must stop using the Service.

16. General provisions

These Terms, together with the Privacy Policy and Refund Policy (where applicable), are the entire agreement between you and us regarding the Service.

If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.

You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

These Terms are governed by the laws applicable to OrioleFly's place of operation, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
